Copyright policy

  1. Introduction

    1. This copyright policy explains how you are permitted to use our service as an authorised user of one of our Client subscribers to our WARC service. Thank you for reading this policy; our ability to invest in high quality content depends on our authorised users complying with it. We reserve the right to change this copyright policy from time to time by publishing an updated policy on WARC.com, which shall become effective and replace any previous policy with effect from publication. This version of the copyright policy was published on July 2015.
    2. We use a number of defined terms in this policy which you will find in paragraphs 2 and 3 below. Their meanings are given in the definitions set out in paragraph 4 below.
  2. Authorised use of subscription materials

    1. You may access the Subscription Services and use the Subscription Materials in accordance with the permitted uses set out in this paragraph 2, subject to the restrictions on use set out in paragraph 3.
    2. You may access the Website Service and use the Website Materials for personal use whilst performing your duties for the Client and in the following manner only:–
      1. View online: To open and view Website Materials from an electronic device which can access the Website;
      2. Save digital copies: To save a single copy of an Item for future reference on the Website using the Website’s ‘My Folder’ or similar functionality or locally on the storage medium of an electronic device provided that the Item cannot be accessed or shared by any other user via any electronic network;
      3. Make hard copies: To make hard copies by printing and/or photocopying individual Items for your own reference only;
      4. Share copies and extracts internally (an example of what is allowed under this permission is set out in paragraph 5 below): To share individual Items (or extracts of them) as a hard copy, PDF file and/or by email with: (a) other Authorised Users for their own reference only; or (b) in the case of a named user licence agreement, with co-workers that are located at the same office as yours.
      5. Share reports incorporating extracts externally (an example of what is allowed under this permission is set out in paragraph 5 below): To incorporate insubstantial extracts from any Item into reports written by you ("User Reports") and to make such reports available, but only to the following:
        1. to other Authorised Users for their reference only, on condition that when you share the User Reports, you are not acting as a central distributor of information to such recipients; and/or
        2. to those clients of the Client that are being serviced from the office that is your usual place of work, on condition that all such distribution will be in hard copy, PDF or commonly used word processing or presentation file format only and for such clients’ own reference only.
    3. You may use the WARC Plus Service using the web form made available by WARC and may use any WARC Plus Materials sent you following such request for personal use whilst performing your duties for the Client and in the following manner only:
      1. View online: To open and view the WARC Plus Materials on screen using an electronic device;
      2. Save digital copies: To save copies of the WARC Plus Materials locally on the storage medium of an electronic device provided that such copies cannot be accessed or shared via an electronic network by users that are not Authorised Users;
      3. Make hard copies: To make hard copies by printing and/or photocopying the WARC Plus Materials for your reference only.
      4. Share copies internally: To share hard or soft copies of the WARC Plus Materials with any other Authorised User only.
    4. You will ensure that any reproduction of the Website Materials (including in any Reports) contains the following notice: "© and database right WARC Limited 20[//]. All warranties and liabilities disclaimed to the fullest extent permitted by law."
  3. Restrictions on use of subscription materials

    1. The Client and Authorised Users will not use the Subscription Materials in any way which is not expressly permitted in clause 5, unless otherwise agreed in writing. In particular, but without limitation the following uses are prohibited:
      1. re-distributing any Item, User Report and/or part or all of the Subscription Materials in any form, by any manner or for any purpose (whether commercial or non-commercial) to any individual who is not an Authorised User, except, in the case of the Website Materials only, as permitted in paragraphs 2.2.4(b) and 2.2.5 (b);
      2. including the Subscription Materials on any corporate intranet, extranet or other web-based product or service operated by or for the Client;
      3. any use which involves you acting as a central distributor of Items, User Reports and/or part or all of the Subscription Materials to other employees of the Client or its Affiliates, whether such employees are Authorised Users or located at the Authorised Office(s) or otherwise;
      4. using the Subscription Materials to compile a database of, or re-creating the whole or substantial part of the Subscription Materials by making repeated and systematic copies of insubstantial parts of, any the Subscription Materials;
      5. using or authorising the use of any automated system or software to extract data from the Website for commercial purposes ("screen scraping") is prohibited; and
      6. sub-licensing (i.e. authorising some else to use) any of the rights granted under this Agreement.
  4. Definitions

    "Affiliate" means any company, corporation or other entity that directly or indirectly controls or is controlled by or is under common control with the Client;

    "Authorised Office(s)" means such of the Client’s and/or its Affiliate’s offices that are identified (whether by individual office address, territory or brand) in the COF subject to any additions and deletions as may be agreed in writing between WARC and the Client from time to time;

    "Authorised User" means:

    1. if the COF specifies that the Agreement is a named user licence agreement, you if your name is included in the COF; or
    2. if the COF specifies that the Agreement is an office licence agreement, you if you are an employee of the Client (or, if expressly stated in the COF, its Affiliate) where your place of employment is located at the Authorised Office(s) specified in the COF.

    "Client" means the company named as such in the COF or ELOA (as applicable);

    "IPRs" means copyright, database right, patents, design rights, trade marks, and all other industrial, commercial or intellectual property rights existing in any jurisdiction and all applications, and rights to apply for registration of any such rights;

    "Item" means an individual item forming part of the Website Material such as, but not limited to, an article, case study, paper, or report;

    "Subscription Services" means the Website Service (subject to any download limits set out in the COF or ELOA) and, if specified in the COF, the WARC Plus Service and "Subscription Materials" means the Website Materials and WARC Plus Materials;

    "Subscription Period" means the period during which the Subscription Services shall be accessible by Authorised Users and for which the Client’s subscription to such services is valid and in force;

    "WARC Plus Service" means the service through which WARC provides responses by email to queries and case study requests by Authorised Users and "WARC Plus Materials" means any emails, reports, documents or material WARC provides to Authorised Users through that service;

    "Website Service" means WARC’s online information service by which the Website Materials are made available from the Website to the Client and "Website Materials" means all text, audio-visual or other content available from the Website from time to time as part of the Website Service, whether accessed via a PC, tablet, mobile or other device using an Internet browser, App or other means of access; and

    "Website" means the website (currently located at www.warc.com) from which the Website Service is made available.

  5. Use cases

    Use case 1: Share copies and extracts internally (see paragraph 2.2.4 above):

    If you and your team are working on a project that utilises Subscription Materials, you can save as a PDF (or equivalent) full articles and share them with either other named users, or if the Client’s licence permits, anyone within the Authorised Office(s). You can also use the forwarding options on the Website to share the pre-written summaries. For example, if you are gathering information on Consumer Behaviour within the young adult market you can click and share the summaries to multiple people within your office, as a full WARC licence is not required to read these summaries.

    If you want to share an extract of an Item, this is also permitted, though WARC should be cited as the source. By an extract, we mean a commercially insubstantial part of the Item when compared to the Item as a whole, for example a chart or one to two paragraphs which add context, or quotes. If you are unsure please contact your CSM.

    For clarity, you can’t:

    • Send full Items to non-Authorised Users (if you are unsure, use the share option on WARC to send a link to the Item)

    • Copy/paste more than 10% of an Item

    • Extract videos and share them.

    Use Case 2: Share reports incorporating extracts externally (see paragraph 2.2.5 above):

    If you work on a presentation on ‘The rise of Digital Media’ for your client, you and any other Authorised Users are permitted to use extracts within this presentation, ensuring WARC is cited as the source. By an extract, we mean a commercially insubstantial part of the Item when compared to the item as a whole.

    This presentation can then be shared with your client as long as it is for their internal use only, for example during internal meetings or research. Please note that the client receiving this report or presentation must be a client serviced from your Authorised Office. You can’t use WARC material in presentations for clients serviced from other offices.

    For clarity, you can’t:

    • Send full Items to non-Authorised Users (if you are unsure, use the share option on WARC to send a link to the Item)

    • Copy/paste more than 10% of an Item.

    • Extract videos and share them.
