COLUMBUS, OHIO - Two smokers have failed in their attempt to bring a class action lawsuit against Philip Morris USA over the way the tobacco company markets "light" cigarettes.
Ohio Supreme Court ruled Philip Morris would have had to act in a way "previously declared to be deceptive" under the state's law, and the smokers failed to demonstrate that fact.
They had argued that Philip Morris knew cigarettes it marketed as having less tar and nicotine would be as dangerous as regular cigarettes.
