A quartet of UK-based tobacco manufacturers – British American Tobacco, Gallaher, Imperial Tobacco and Rothmans – will today [Monday] argue before the Law Lords their case against an across-the-board advertising ban. Their appeal to the House of Lords is based on the premise that the British government is wrong to attempt to impose the ban in advance of European Union legislation.

The roll-out of an early UK ban was originally set for 10 December last, but the manufacturers won a stay of execution from the UK High Court pending the European Court’s ruling (expected before October) as to the legality of the original EU directive banning tobacco advertising, promotion and sponsorship by October 2006.

Meantime, the latest UK hearing is expected to last two days – although a decision is unlikely before next month.
