THE HIGH COURT ATTEMPT by Cable & Wireless Communications to block a BT brochure mailing failed when Mr Justice Jacob lifted a temporary injunction restraining distribution of the brochure. The offending brochure contends that BT’s telephone charges to small and medium-size businesses are lower than its rivals - a claim hotly disputed by C&WC. The judge said that based on the information available to him, BT would probably be able to substantiate this claim if the issue went to trial. After the hearing, C&WC reiterated that BT was attempting to 'confuse the market' and insisted it would pursue the matter to a full hearing, even though this might take up to six months. Afshin Mohebbi, BT Business Division marketing director, explained BT’s altruistic motives: 'We always believed it was in the interest of UK business for us to clarify the real cost of business telephony charges.'
