Sending a marketing e-mail with a false address or domain name is to become a misdemeanor criminal offense, following legislation approved yesterday by the US House of Representatives.
The bill, introduced by Heather Wilson (Republican, New Mexico), requires that all commercial email is clearly labelled as such. It will also be illegal to send "junk'' email to anyone who has asked to be removed from a list.
The new law is broadly supported by the Direct Marketing Association, although it voices concern over two of the bill’s provisions: a private right of action that allows individuals to sue marketers for violation; and government legal action against marketers who violate policies posted by internet service providers.
The bill now moves to the Senate for approval.
