Court Declares New York’s Cigarette Mail-Order Ban Unconstitutional

New York State’s ban on the sale of cigarettes by mail-order has been ruled unconstitutional by a federal judge.

The ten-month-old embargo was challenged in October by Brown & Williamson Tobacco, America’s third biggest cigarette manufacturer, whose BWT Direct unit wants to sell cigarettes via catalogs, fax, phone, mail and eventually the web.

The ban – which was temporarily lifted while the US District Court heard the case – was found by judge Loretta Preska to violate interstate trade laws.
