An appeals court in Washington has been asked by the Federal Communications Commission to review a ruling by a three-judge panel in February that threw out the FCC regulations banning ownership of cable systems and broadcast stations in the same market [WAMN: 20-Feb-02].
The watchdog also wants to overturn the concurrent ruling that forces it to justify its retention of the ownership limit forbidding broadcasters from reaching over 35% of US viewers with their stations. The FCC’s 1998 decision to keep the cap was described as “arbitrary and capricious and contrary to law” by the judges.
