E-marketers could end up in court if they continue to flout new spam laws, warns Jupiter Research.

David Daniels, research director for the internet specialist, says some email marketers are “doing what amounts to a virtual high wire act without a net.” As a result they are putting their companies at risk.

His comments follow a survey of more than fifty leading e-marketers which tracked if they were complying with the so-called Can-Spam Act.

Nearly 25% of marketers continued with messages after receiving opts-outs, while 16% ignored the prescribed 10-business day period for excising removal requests from their databases.

There is a similar situation in the UK. According to a survey of 50 top companies more than half were ignoring or ignorant of recent European Union legislation on spamming.
